Terms and Conditions

Payment: There is a 50% charge required at the time of reservation if reservation is made within 60 days of check in date. Prior to 60 days out a  deposit of $100 is required to make a reservation. Within 60 days deposit is non-refundable. The remaining balance is due 7 days prior your arrival. The balance is billed automatically to the same credit card unless you contact us with additional payment instructions. Reservations made less than 30 days prior to arrival require full payment in advance.

Confirmation: Confirmation of the reservation will be emailed to address provided by you upon receipt of deposit. Guest(s) should review the confirmation for accuracy of dates, mailing address, and accommodations. Guest(s) must notify Luxury Cabins at 251-975-8465 of any discrepancies in the reservation immediately upon receiving the confirmation. Please allow 24 to 48 hours to receive your directions after full payment is made.

Cancellations: Deposit is non-refundable. Cancellations that result in a shortened stay, or that are made within 30 days of the arrival date, forfeit the full advance payment and damage/reservation deposit. Cancellation or early departure does not warrant any refund of rent or deposit. Should you need to make a change of date, we will transfer deposit to a new date up to one year at the same cabin with a $25 transfer fee.

Cancellations - Reservations booked with a discount- Under the terms and conditions of all special discount promotions, you may not cancel or change your reservation. You will also not be eligible for any type of monetary refund.

Reservation Policies/Agreement: Be sure to read over these terms and conditions and make sure that everyone in your party is aware of them. The contracted renter is responsible for the entire party.

Rental Acknowledgment: Guest acknowledges and understands that he/she is a licensee of the Owner and not a tenant; and that he/she is not acquiring any interest in the property. It is understood that the unit is privately owned including the furnishings. We reserve the right to refuse service at our discretion.

Security Deposit:  The Rental Unit Damage Protection plan covers unintentional damages to the rental unit interior that occur during your stay, provided they are disclosed to management prior to check-out. The policy will pay a maximum benefit of $1500.00. If, during your stay at one of our Rental Properties, an Insured Person causes any damages to real or personal property of the unit as a result of inadvertent acts or omissions, the Insurer will reimburse the insured for the cost of repair or replacement of such property up to a maximum benefit of $1500.00. Certain terms and conditions apply. Full details of the Rental Unit Damage Protection Coverage are contained in the Certificate of Insurance or Insurance Policy. The Rental Unit Damage Protection can be purchased up to, and including at, check in. By submitting payment for this plan, you authorize and request CSA Travel Protection to pay directly Luxury Cabin Vacations any amount payable under the terms and conditions of the Rental Unit Damage Protection.  If your damages exceed $1500, the jurisdiction for a small claims action against you shall be Sevier County, Tennessee. 

 Hold Harmless:  Owner does not assume any liability for loss, damage or injury to persons or their personal property. Neither do we accept liability for any inconvenience arising from any temporary defects or stoppage in supply of water, gas, electricity or plumbing. Nor will the owners accept liability for any loss or damage caused by weather conditions, natural disasters, acts of God or other reasons beyond our control.

 Guest's Liability:  You agree to accept full liability for any damages. You agree to reimburse the owner for any damages or repairs. We are not responsible for any damaged or stolen property. Always take your valuables with you.

Damages and Excessive Cleaning: Guest agrees to leave the cabin in an undamaged condition. Guest understands they are solely responsible for, and assume all liability for any damages to the cabin during their stay. In the event of damage, theft, or the need for excessive cleaning, the security deposit insurance will be used. If charges exceed the security deposit insurance limits, guest authorizes rental agent to charge the credit card on file. Should the guest dispute the charges or the credit limit on the credit/debit card on file is not sufficient to cover the damages/theft/cleaning, rental agent reserves the right to charge the guest with vandalism and pursue collection from the guest with venue being in the county of Sevier, State of Tennessee. All reasonable attorney fees will be at the expense of the guest if collection becomes necessary. Any damages or problems not reported by the guest upon arrival will be charged to the guest. Any accident or damage to personal property while at a cabin must be reported within 24 hours of occurrence.

Check in/Check out: The guest(s) understand and agree that check in time begins after 4:00 p.m. Every attempt is made to have the cabin prepared for check in at that time, but access to the property is given only after the home has been inspected and cleaned. No one may request a key or lock combination except the contracted renter; unless prior arrangements have been made Check out time is not later than 10:00 a.m. with exceptions. An additional night stay will be charged for late checkouts.

Use of the Premises: Guest(s) understands they are solely responsible for any property damage, accident injury to any person(s) or loss sustained by any person, including loss of money, jewelry, and other items of personal property. Guest(s) shall inspect and be familiar with proper use and application of all items of personal property in the home prior to using them. Guest(s) hereby agrees to IDEMNIFY and hold homeowner harmless from any and all claims including those of third parties, arising out of or any way related to Guest(s) use of premises or the items in personal property provided therein. Guest(s) assumes the risk of injury or other losses relating to any recreational activities and will hold owner and its agents harmless with respect there to.

Occupancy and use of premises shall not be such as to disturb or offend neighbors or residents. This vacation home has been designed for individual and family use only. If a disrupted party or situation develops, all guests will be asked to leave immediately without refund. This policy is enforced without exceptions.

NO STUDENT GROUPS OR HOUSE PARTIES OF ANY KIND - If guests are found to be having a party in any of our units, everyone will be asked to vacate the premises. No refunds will be given.

Noise complaints: The resorts maintain quiet hours between 11pm and 7am. I understand that if I or any of my guests disturb a guest during their stay requiring a call from the Night Manager, I will be billed $50 per call. If it required for the police to come out, I will be charged $200. If there are three complaints during my stay I will be asked to leave the resort with no refund.

Check out Procedures: Please turn AC on 80 degrees when you are checking out during the summer months. Turn the heat to 62 degrees in the winter months. Please do not turn off Heating/Air units when your stay is over. Please put all trash in outside containers that have been provided. Do not leave dirty dishes. Make sure all windows and doors are locked before leaving. After inspection, if extra cleaning is required you will be charged the appropriate fee on the credit card that has been provided by the name on reservation.

Damage/Theft: Guest(s) agrees to leave the premises in a clean, undamaged condition. Guest shall be responsible for all intentional or reckless damages, which includes damages while under the influence of drugs or alcohol, caused by any member of the party staying or visiting the reserved cabin. The credit card on file is authorized for charge of any/all damages occurring during the scheduled stay.

Guest(s) hereby authorize the owner to charge any expenses related to intentional or reckless damage, cleaning of the unit beyond normal wear and tear or related to theft. If at any time the housekeeping crew is required to clean up an unexplainable mess, the guest will be charged a double cleaning fee. Missing or damaged items from the cabin will be replaced at current retail value plus a minimum $100.00 service fee and charged to the guest(s).

Minimum Stays: We have two nights minimum stay on all reservations. Some holidays and other peak season weekends require a 3 or 4 night minimum stay. Rates vary according to season, length of stay and promotions.

Hot Tub Usage: Hot tubs will be inspected after each rental. Cover should remain on the hot tub at all times when not in use. Our professional hot tub cleaners drain, sanitize and fill prior to each guest arrival. Owner is not responsible for injury while using hot tub. Please consult your physician before entering any hot tub. Pregnant women are advised not to use hot tub. DO NOT ALLOW CHILDREN TO PLAY IN HOT TUB OR BE LEFT ALONE FOR ANY REASON. Do not wear jewelry in hot tub. We are not responsible for any damage or loss to jewelry of any kind. Damage to any cover will result in a $350.00 charge. Guest is not to drain hot tub.

HOT TUB WARNING: Persons with heart conditions, skin sensitivities, pregnant women and children under the age of 16 SHOULD NOT use the hot tub. There is medical research indicating that being in a hot tub can cause an unsafe drop in a young person's heart rate and can dangerously increase his or her body temperature. Children are also more prone to skin irritation from the chemicals in the water. A hot tub is not a swimming pool. Submersing in a hot tub by any person can result in serious eye, ear and respiratory diseases.

Mandatory Procedure for Use of Hot Tubs: Shower before entering hot tub. Bacteria on your body can result in bacteria in the hot tub.  Do not use any type of oil or bubbles. Shower off immediately after hot tub use.

 Occupancy: Cabin occupancy is to be limited to the number of paying Guests. Allowing others to occupy the cabin that have not paid, will subject the Guest(s) to additional fees with appropriate charges. The minimum age to reserve the cabin is 21.

Cabin Supplies: Owner will provide a starter supply of a variety of complimentary and non refillable items such as soap, dishwasher detergent, toilet paper, trash bags, and paper towels. The cabin is also supplied with linens and towels, as well as kitchenware and utensils. All linens, towels, kitchenware, and utensils are inventoried upon check out. The Guest will be charged for any missing/damaged items. Owner is not responsible to provide clean linens or towels to guest during the stay. Guest(s) is completely responsible to clean/wash their entire environment during their stay.

Pets/Smoking: Pets are allowed, subject to our pet policy, only with a payment of $50.00 per pet nonrefundable fee. When leaving the cabin please make sure that all pets are properly caged. Smoking is not permitted inside the cabin unless outside or on the deck. Please make sure to discard all cigarette butts inside a proper disposal. If a pet is discovered in your cabin and not reported you will charged a $250.00 fee. Please be honest and let us know. Not all cabins are pet friendly.

Items Left in Unit: Owner will not be responsible for any personal items left in the cabin. A $20.00 service charge plus postage is required if you request us to pick up and ship any items left in the unit.

Malfunctions: We do not guarantee that utilities, appliances, or amenities will not fail, but we do guarantee that repairs will be made as soon as possible. No refunds will be made due to any failures. Guest understands and agrees that there are circumstances beyond the owner's control, and no recourse or action can be brought against the owner for these circumstances. For example: malfunction of plumbing or electrical, construction activity, or other situations over which the owner has no control. Please contact our maintenance man at 865-235-6743 for any maintenance issues.

FALSIFIED RESERVATIONS: Any reservation obtained under false pretense will be subject to forfeiture of advance payment, deposit and/or rental money, and the party will not be permitted to check in.

Parking: Vehicles are to be parked in designated parking areas only. Parking on the road or yard is not permitted. Any illegally parked cars are subject to towing; applicable fines/towing fees and is the sole responsibility of the vehicle owner.

Storm Policy/Road Conditions: No refunds will be given for storms. Mountain roads can be curvy and steep. Gravel drives are well maintained, however we do not refund due to road conditions.

No Daily Maid Service: While linens and bath towels are included in the cabin, daily maid service is not included in the rental rate however is available at an additional rate. We suggest you bring your own beach towels. We do not permit towels or linens to be taken from the cabins.

Fireplaces: Fireplaces that are electric are usable year-round, but should not be used at any time when air conditioning is on in the cabin. Gas fireplaces are seasonal and are not in operation from April through September. The owner does not supply wood for wood burning fireplaces.

Insects: Each of our properties is treated by a licensed pest control company on a regular basis. It is not unusual to find bees, spiders or other insects in and around the cabins. Please understand you are in the mountains, and there may be, on occasion, an uninvited guest. There will be no refunds given for visits from these "uninvited guests".

Tax-Exempt Reservations: A Tennessee tax-exempt certificate or 501c3 tax-exempt certificate must be provided by any group wishing to claim tax exemption. For these types of reservations, several criteria must be met: (1) The reservation must be made in a group name. (2) Payment must be made by a form of payment showing the group name (i.e. credit card issued in the group name, check with the group name on the account, etc.). (3) The group name on the tax-exempt certificate must match all of the above. Request for tax-exemption must be made at the time of booking. A valid tax-exempt certificate (as stated above) must be submitted to the rental agent at the same time the signed Agreement is returned, which should be within 14 days of making the reservation.

Lost or Stolen Items: Rental agent is not responsible for lost, stolen or damaged items. Guest items which are found will be returned to the maintenance office. Items can be returned at the guest’s expense.

Privacy Statement: Owner does not divulge any guest's personal information to any third party without the guest's express consent. Please our Privacy Policy on our website
